Shops can be built once the Dwarven Economy has started in your fortress and won't appear in the building list. As the Dwarven Economy is disabled in current versions as a result shops cannot be built. Toady One has stated that after various other changes have been made to the game he will re-enable the economy and thus re-enable the building of Shops
