The sheriff arrives with the Manager, who arrives once the population of your fortress reaches 20. The sheriff will subdue and imprison lawbreaking dwarves in jails, receiving unhappy thoughts if you do not have enough in your fortress (at least one for every 10 citizens). Without sufficient jails, the sheriff will have no choice but to issue summary justice in the form of beatings. Having a weak sheriff is a good thing - a sheriff with good strength could heavily injure or kill a "criminal" whose "crime" was not being able to make gold or platinum items because you hadn't yet reached the magma flow.
When your fortress population reaches 50 dwarves, the sheriff will be promoted to Captain of the guard.
Due to a bug, unhappy thoughts about insufficient jails only happen for the first 3 months after arrival as a migrant, rather than starting after that grace period (Bug:5844). A patch for version 0.23.130.23a can be found below which fixes this problem:
